Quick answer: If you are retrenched in Singapore on a work pass, two things happen at once. Your employer must notify MOM within 5 working days of telling you, and must cancel your work pass, normally within a week of your last day. Once the pass is cancelled you cannot work, and your right to remain comes from whatever MOM issues next: the employer can request a Short-Term Visit Pass, valid for up to 90 days, so you can wind things up or look for a role. Your family’s Dependant’s Passes end with your pass, and tax clearance has to be sorted before your final pay is released.
Most retrenchment guides in Singapore are written for citizens, and focus on compensation. If you are on a pass, the urgent questions are different: how long can I stay, what happens to my family, and does this kill my PR application.
What your employer must do
| Obligation | Detail |
|---|---|
| Notify MOM | Employers with a Singapore-registered business and at least 10 employees must notify MOM of any retrenchment, within 5 working days of informing the affected employee. Since 1 November 2021 this applies to every retrenchment, not only to groups of five or more |
| Cancel the work pass | Normally within 1 week of your last day, or within 1 week of your departure if you have already left |
| Tax clearance | File Form IR21 with IRAS, normally at least one month before your last day, and withhold your final pay until IRAS issues a clearance directive. See our guide to IR21 tax clearance |
| Repatriation | Provide reasonable notice and cover the cost of sending you home where that obligation applies |
| Retrenchment benefit | Employees with at least 2 years of service are eligible, with the amount set by the contract or collective agreement. Those with less may receive an ex gratia payment |
The notification duty is MOM’s, not yours, but knowing it exists is useful: it is a sign of whether your employer is following the process.
What happens to your stay
| Stage | Your position |
|---|---|
| Notice period, pass still valid | You remain employed, and the pass is still live |
| Last day, pass cancelled | You cannot work from that point |
| After cancellation | The employer can request a Short-Term Visit Pass, valid for up to 90 days, so you can remain legally while you settle affairs or job-hunt. You cannot work on it |
| Found a new job | The new employer applies for a new pass. You cannot start work until it is issued |
| No new job before the STVP ends | You need to leave before it expires. Overstaying is an immigration offence |
Your family
Dependant’s Passes and LTVPs are tied to your pass. When yours is cancelled, theirs end too.
| Family member | What happens |
|---|---|
| Spouse on a Dependant’s Pass | The DP ends with your pass |
| Children on Dependant’s Passes | Same |
| Spouse working on their own EP or S Pass | Unaffected, and they may be able to sponsor a DP for you instead |
| Children in school | Plan early, since a Student’s Pass has its own requirements |
If your spouse holds their own work pass and earns at least S$6,000 a month, the family can often be restructured around their pass. Our guide to the Dependant’s Pass sets out the requirements.
If your PR application is pending
A retrenchment does not automatically end a pending PR application, but it changes the facts ICA is assessing, because economic contribution and current employment are part of the picture.
| What to do | Why |
|---|---|
| Update ICA through the Update Information function in your case summary page | The assessment is made on the information ICA holds. See our guide to updating a pending PR application |
| Decide whether to continue or withdraw | Covered in our guide to changing or losing your job while your PR is pending |
| Do not submit a second application | Update the existing one instead |
Your checklist in the first week
- Get the retrenchment letter in writing, with your last day stated
- Confirm when the employer will cancel the pass
- Ask the employer to request a Short-Term Visit Pass if you need time here
- Confirm the employer is filing IR21 and understand that your final pay is withheld until clearance
- Check retrenchment benefit against your contract
- Tell ICA if you have a PR application pending
- Work out your family’s pass position
- Start job-hunting with the pass timeline in mind, not the notice period
Practical realities people miss
Your final pay is not late, it is withheld. Under tax clearance rules the employer holds all monies due until IRAS issues a directive. That is the law, not the employer stalling.
The new employer’s application is assessed on their profile. An Employment Pass application is scored against that company’s COMPASS position, including its nationality mix and local PMET share. A role you could fill at your old employer may score differently at a new one. Our EP renewal guide explains the criteria, and the salary floor rises again in 2027.
90 days goes quickly. Between notice, cancellation and a new application taking its own processing time, plan from the first week rather than the last.
How First Immigration can help

- New pass applications with a prospective employer, including a COMPASS pre-check, through our Employment Pass service.
- Family restructuring, where a spouse’s pass can carry the household.
- Pending PR applications, including what to tell ICA and when.

Frequently asked questions
What happens to my work pass if I am retrenched in Singapore?
Your employer cancels it, normally within a week of your last day. Once cancelled you cannot work.
How long can I stay in Singapore after being retrenched?
Your employer can request a Short-Term Visit Pass, valid for up to 90 days, so you can remain legally. You cannot work on it.
Does my employer have to notify MOM?
Yes, if the business is Singapore-registered and has at least 10 employees. The notification is due within 5 working days of informing the affected employee.
Am I entitled to retrenchment benefit?
Employees with at least 2 years of service are eligible, with the amount set by the contract or collective agreement. Those with less may receive an ex gratia payment.
Why is my final salary being withheld?
Tax clearance. The employer must file Form IR21 and withhold monies due until IRAS issues a clearance directive.
What happens to my family’s Dependant’s Passes?
They end with your pass. If your spouse holds their own pass and earns at least S$6,000 a month, the family may be able to restructure around it.
Can I look for a new job while on a Short-Term Visit Pass?
You can be in Singapore and attend interviews, but you cannot work until a new pass is issued.
Does retrenchment cancel my pending PR application?
No, but it changes the facts ICA assesses. Update ICA and take advice on whether to continue.
How quickly can a new employer get me a pass?
It depends on the pass type and the company’s own COMPASS profile. Start the conversation early rather than at the end of your visit pass.
What if I cannot find a job before my visit pass expires?
You must leave Singapore before it expires. Overstaying is an immigration offence that affects future applications.
